TERMS OF SERVICE

This may be long, but please take the time to read over this for the benefit of the both of us.

GENERAL
☽ I have the right to refuse your commission. I do not have to give a reason.
☽ I will need you to say "I agree to your TOS" (or some variant of it) after reading it. This is so I can have screenshot proof. (If I don't get a screenshot of your agreement, then by paying, you are still agreeing to the TOS).
☽ I require a proper visual reference. The image may not be blurry or unclear. If you do not have a proper reference, it is $5 USD extra.
☽ I will not change my art style, emulate someone else’s art style, etc. If you don’t like my art style, don’t expect something different. I am glad you chose me to do artwork for you, but you chose my style specifically!
☽ Once the commission is finished, I will not make any changes unless it was a mistake on my part.
☽ Please get back to me ASAP (and I will try to do the same). I understand life happens, but do not ghost me. If I am ghosted your commission may be put on hold, or I may cancel it altogether. If I am ghosted for more than a month without prior notice, I will not offer a refund.
☽ DO NOT copy, trace, edit, or claim my artwork as yours.
☽ Only the client may repost (with credit of me by tagging or mentioning me).
☽ Commissions are for personal use (icons, character galleries, printing it out for you, etc.). You may not make a profit off of them.
☽ Please credit me when sharing online. My artwork is not made for commercial use unless stated otherwise.
☽ I reserve the right to post any art I make and use it for advertising or other nonprofit uses. I will never resell the art I make you without explicit permission. If you are uncomfortable with being tied to the art, please let me know if you would not like me to tag/mention you.
☽ I am not responsible for keeping past artwork, so PLEASE save your commissions! If you have lost your work, please contact me about the work and I will see if I still have it. I am in NO WAY obligated to refund or replace the lost artwork.
ARTWORK USAGE
☽ Payments must be fully paid BEFORE I start working. I will not begin until I receive the payment.
I use Zelle; therefore, I will give you my information (Name/Phone#) to create a contact for me. This is the only way I will accept payment. *If you are unable to use Zelle, please let me know and we can switch to PayPal as a last resort).*
☽ I will send each client a Google Form that will be titled "Mahogany Marten Invoice". Since Zelle does not create Invoices, this will be my way to keep track of transactions! This will guide you through the process of telling me what you would like and how to send payment through Zelle!
☽ By paying you are automatically agreeing to my TOS.
☽ You may split the payment with another person, but I will not start until I have received both payments.
☽ If I have to cancel a commission, you will get a full refund, regardless of what stage I'm on.
☽ Refunds are available if I have not started your commission. Refunds are NOT available after the artwork is completed or is beyond the sketch process.
☽ I can cancel a commission if a client is harassing me, being rude, constantly changing their mind, etc.
☽ Chargebacks are NOT ACCEPTABLE under any circumstances.
☽ Should you buy a commission from me and I put them on sale (or lower price) at a later time, I am not obligated to refund you, give you free art, etc.
☽ If a commission is canceled or you request a refund, I have a right to use and/or sell the unfinished piece (all features unique to your character will be removed).
☽ If you have a deadline, it is potentially extra depending on how much time I have to complete the commission. If I do not meet the deadline, you will receive a refund for the extra money charged.
☽ Failure to pay within 48 hours will result in your commission to be cancelled.
PAYMENT AND REFUNDS
HOW TO COMMISSION ME / WHAT TO HAVE READY
I'm so glad you have chosen to commission me! Please contact me through Discord to have your request seen. If Discord does not work, please use Instagram or Twitter. And if those do not work, shoot me an email at mahoganymarten@gmail.com. Make sure you check my Trello for my commission status! I am a student and my schoolwork takes priority over commissions, so I apologize if I am ever slow.
Please have:
- What type of commission (headshot, halfbody, fullbody, etc.)
- What type of coloring (flat color, shaded, etc.)
- Whom you would like me to draw (proper, clear reference)
- What type of pose you would like said character in (a picture to describe is just fine!)
- Where you would like WIPs to be sent (DM on contacted app or another app)
☽ I will not alter the drawing after you have approved the sketch unless it was a mistake on my end. Make sure you are happy with what you see!
☽ I will not move my watermarks from where I put them. I will provide you with a watermarked and unwatermarked file. I request that you do not share the unwatermarked file online for it may be subject to being stolen.

If you break any of the terms, you automatically forfeit the right to use the art I give you.
If you are problematic during/after the commission, you may be blacklisted.
